This website (the “Site”) at 112svgroup.com is owned and operated by 112SV Group LLC, a California limited liability company (“112SV Group,” “we,” “us”). By using the Site, booking an appointment with us, or opting into our text messages, you agree to these Terms of Service, our Privacy Policy at https://112svgroup.com/privacy-policy, and any additional terms that apply to a specific service or product. Accessing the Site in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to these Terms.

1. Our products have their own terms.

Residly, our software product for rental operators, is governed by its own Terms of Service at https://getresidly.com/terms-of-service, which control for anything to do with a Residly membership. Client engagements for our AI and automation services are governed by the written agreement signed for that engagement, which controls if it conflicts with these Terms.

2. SMS messaging terms.

We comply with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines for our text messages.

Program description: our messaging program sends appointment confirmations, reminders, rescheduling updates and customer support messages to people who booked an appointment with 112SV Group LLC through this Site or our scheduling forms and explicitly opted in to receive text messages. Opt-in is collected on our web forms with a dedicated checkbox for SMS consent.

Cancellation: you can cancel at any time by texting “STOP” to the number that sent the message. We will confirm your unsubscribe by text, and you will receive no further messages unless you opt in again.

Support: reply “HELP” for assistance, or contact us at 510-519-0360 during business hours.

Carrier liability: carriers are not liable for delayed or undelivered messages. Message and data rates may apply. Message frequency varies with your service usage and appointment schedule. Our program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint and most regional carriers.

Age: you must be 18 or older to participate in our SMS program.

3. Changes to these Terms.

We may change these Terms or add conditions for use of the Site from time to time. The current version, with its effective date, is always posted on this page. Continuing to use the Site after a change means you accept the change.

4. Intellectual property and your licence to use the Site.

The Site and all materials on it belong to 112SV Group LLC or our licensors and are protected by copyright, trademark and other intellectual property laws. The Site is provided for your personal, non-commercial use. Unless we authorize it in writing, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works from, exploit or distribute any material from the Site. You may download or print one copy of individual pages for your personal, non-commercial use, keeping all copyright and proprietary notices intact.

5. Material you send us.

If you post or submit material to us through the Site, internet groups or other digital venues (comments, testimonials, photos, videos), you confirm that you own it or have permission to share it, and you grant 112SV Group LLC a royalty-free, perpetual, irrevocable, non-exclusive, worldwide licence to use, modify, transmit, display, distribute and create derivative works from it.

6. Third-party links and online commerce.

The Site may link to sites maintained by third parties. Linking does not mean we endorse them, and we are not responsible for their content, products or services. If you purchase from a third party linked through the Site, that transaction is solely between you and that third party, and information you provide, including payment information, may be collected by both the merchant and us. 112SV Group LLC is not responsible for any loss or damage from dealings with third parties.

7. Accounts and passwords.

Some features may require you to register. You agree to provide accurate, current and complete information and to keep your login details confidential. You are responsible for all activity under your account. If you suspect unauthorized use, email info@112svgroup.com immediately.

8. No warranty.

The information, products and services offered on or through the Site are provided “as is” and without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Nothing on the Site is legal, tax, accounting or financial advice.

9. Limit on liability and your responsibility to us.

To the fullest extent the law allows, 112SV Group LLC is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site. You agree to indemnify and hold harmless 112SV Group LLC, its affiliates, officers, directors, agents and employees from claims, damages, liabilities, costs and expenses arising from your breach of these Terms or your use of the Site.

10. Termination.

We may suspend or end your access to the Site without notice if we determine you have violated these Terms or used the Site unlawfully. On termination you must stop using the Site and any content obtained from it.

11. Governing law and disputes.

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. If you have a problem, email us first and we will try to resolve it within 30 days. Any dispute that we cannot resolve that way will be settled by binding arbitration in California, conducted by a recognised arbitration provider under its consumer rules, and judgment on the award may be entered in any court with jurisdiction. Either of us may instead bring an eligible claim in small claims court. You and 112SV Group LLC each agree to bring claims only in an individual capacity, not as part of a class or representative action.
